Terms

By using the Nowby app (the "App"), you accept these Terms. If you don't agree with them, don't use the App. These Terms supplement the Privacy Policy, which explains how we process data.

1. Who can use it

• You must be 16 or older.
• You can use the App anonymously or sign in with Apple. You're responsible for what happens on your account.

2. What the App is

Nowby helps you meet people in real life: you post a "ping" (an intent for right now), you see the approximate area of other open people, and you meet up in person, where bringing your phones close saves a contact. The App works on demand and doesn't monitor you in the background.

3. Your content

By posting a ping or setting a profile or avatar, you publish content. It stays yours, but you grant us a limited license to display it in the App so the App can work. You're responsible for having the right to publish it and for it not breaking the law or anyone else's rights.

4. Zero tolerance for offensive content and behavior

Nowby has a zero-tolerance policy for objectionable content and harassment. The following are prohibited in particular:

• offensive, hateful, harassing, threatening, discriminatory or demeaning content;
• sexual or pornographic content, or content that exploits minors;
• harassment, stalking, impersonation, spam and fraud;
• illegal content, content promoting violence, or content that violates others' rights (including privacy).

5. Reporting and enforcement

• In the App you can report a ping or a person and block any user.
• We review reports and remove violating content and block offenders within 24 hours of receiving a report.
• We may remove content, or suspend or delete an account that violates these Terms, including without prior warning.
• You can also report abuse by email: hello@nowby.to.

6. Meeting safety

The App lets you contact strangers. You meet others at your own risk. Use common sense: meet in public places, don't share sensitive information, and trust your instinct. We don't verify users' identities and aren't responsible for the behavior of other people.

7. Acceptable use

You agree not to:

• use the App unlawfully or against these Terms;
• circumvent security, privacy or technical limits;
• harvest other users' data, or fake your location or identity.

8. Account deletion

You can delete your account and your cloud data at any time in the App: Settings → Account → Delete account. Details are in the Privacy Policy.

9. No warranty and limitation of liability

The App is provided "as is", without any warranty of continuity or of being error-free. To the extent permitted by law, we aren't liable for damages arising from your use of the App or from contacts made through it.

10. Changes

We may update these Terms. We'll inform you of significant changes in the App. Continued use after changes means you accept them.
